Trump Signs Landmark “Take It Down Act” Criminalizing Nonconsensual AI-Generated Deepfake Porn
On May 19, 2025, President Donald Trump signed the "Take It Down Act" into law, a significant bipartisan measure aimed at combating the distribution of nonconsensual intimate imagery, including both traditional "revenge porn" and AI-generated deepfakes. The legislation criminalizes the publication or threat of publication of such content without consent, with penalties of up to three years in prison for offenses involving minors. It also mandates that online platforms remove flagged content within 48 hours and make efforts to eliminate copies, with enforcement overseen by the Federal Trade Commission.
First Lady Melania Trump played a pivotal role in advocating for the bill, aligning it with her "Be Best" initiative focused on children's well-being. During the signing ceremony in the White House Rose Garden, she emphasized the importance of protecting individuals, especially young people, from having their images or identities abused through non-consensual intimate imagery.
The law received overwhelming support in Congress, passing the House with a 409–2 vote and the Senate unanimously. It represents one of the first federal efforts to regulate AI-generated content in this context, addressing growing concerns over the misuse of technology to create exploitative and realistic fake content, primarily targeting women and public figures.
While the legislation has been widely endorsed by industry leaders and advocacy groups, some digital rights organizations have voiced concerns regarding potential privacy and free speech issues. Critics argue that the law may suppress legitimate content and threaten privacy tools like encryption. The Cyber Civil Rights Initiative, despite advocating against image-based abuse, opposed the bill over concerns that it could embolden politically favorable platforms to ignore reports or be overwhelmed by false claims.
This legislative action underscores a growing recognition of the need to address the challenges posed by digital content manipulation and its impact on individuals' privacy and dignity in the digital age.
