India's Crypto Sector Pushes for Tax Relief Amid Signs of Government’s Softening Approach

India's cryptocurrency industry is intensifying its lobbying efforts for tax reforms, aiming to revitalize domestic trading and align with global standards. This push coincides with a perceived softening of the Indian government's stance on digital assets, influenced by international developments and domestic policy shifts.

Industry's Tax Reform Demands

The Indian crypto sector is advocating for several key changes to the current tax framework:

  • Reduction in Tax Deducted at Source (TDS): The industry is urging a decrease in the TDS rate from 1% to 0.01% to alleviate the financial burden on traders and encourage domestic participation.

  • Capital Gains Tax Adjustments: Proposals include aligning crypto capital gains tax with those of traditional assets, potentially reducing the rate from the current 30% flat tax.

  • Loss Offsetting Provisions: Allowing traders to offset losses from crypto transactions against other income sources, similar to provisions for other financial instruments, is a key demand.

  • Regulatory Clarity: The establishment of a clear and comprehensive regulatory framework is sought to provide legal certainty and foster innovation within the sector.

These measures are seen as essential to curb the exodus of Indian investors to foreign exchanges and to stimulate growth in the domestic crypto market.

Government's Current Position

Despite these appeals, the Indian government has maintained its existing tax policies. The 2024-25 Union Budget did not introduce any changes to the crypto tax regime, leaving the TDS rate at 1% and the capital gains tax at 30%. This continuity suggests a cautious approach, possibly due to concerns over financial stability and the speculative nature of cryptocurrencies.

However, there are indications of a more open dialogue between the government and the crypto industry. Meetings between industry leaders and policymakers have become more frequent, signaling a willingness to engage and potentially reconsider aspects of the current framework.

Global Influences and Domestic Developments

International factors are also playing a role in shaping India's crypto policy. The re-election of Donald Trump as U.S. President and his support for digital currencies have influenced global perceptions of crypto assets. This international context may be encouraging Indian policymakers to reassess their stance to remain competitive and aligned with global trends.

Domestically, the government's broader economic strategies, such as tax cuts for middle-income individuals and small businesses, reflect a shift towards stimulating growth. These initiatives may pave the way for more favorable policies towards the crypto sector in the future.

While the Indian government's current tax policies remain unchanged, the increasing dialogue between the crypto industry and policymakers, coupled with global developments, suggests a potential for future reforms. The industry's calls for tax reductions and regulatory clarity are gaining attention, and there is hope that these efforts will lead to a more conducive environment for crypto innovation and investment in India.
