Australian Regulator Takes Legal Action Against Former ACX Director for Alleged Mismanagement and Misuse of Customer Funds

The Australian Securities and Investments Commission (ASIC) has initiated legal action against Liang "Allan" Guo, the former director of Blockchain Global, the company behind the now-defunct ACX Exchange. ASIC's lawsuit alleges that Guo misused customer funds and breached his director's duties, contributing to the exchange's collapse in 2019.

Background

ACX Exchange, operational from 2016 to 2019, allowed users to trade cryptocurrencies. However, the platform ceased operations abruptly, leaving many customers unable to access their funds. In October 2021, Blockchain Global entered voluntary administration, and by February 2022, liquidators were appointed to manage the company's affairs. Investigations revealed that the company owed creditors approximately $50 million.

Allegations Against Guo

ASIC's legal proceedings focus on several serious allegations against Guo:

  • Misappropriation of Funds: Guo is accused of transferring $2.6 million of investor funds to his personal home loan and retaining 23.11 bitcoins (valued at about $1.8 million) that belonged to Blockchain Global.

  • Improper Use of Customer Funds: Investigations revealed that over $20 million of customer funds were used to provide loans to support Blockchain Global's operations, rather than being kept in reserve for customer withdrawals.

  • Poor Record-Keeping: The company allegedly mingled customer funds into a single pool without proper documentation, making it impossible to distinguish between individual customer holdings.

Legal Actions and Restrictions

In response to these allegations, ASIC has secured interim travel restraint orders against Guo, preventing him from leaving Australia until at least August 2024. The Federal Court's decision was based on concerns that Guo might attempt to leave the country before authorities could question him.

Guo is the only director of Blockchain Global still residing in Australia, as his colleagues, Samuel Xue Lee and Zijang "Ryan" Xu, have reportedly fled the country.

Impact on Investors

The collapse of ACX Exchange has had significant financial repercussions for its users. Many investors, such as Bruno Fabre, have reported losing substantial amounts of money, with some claims exceeding $100,000. Despite efforts to recover funds, many customers remain without access to their investments.

This case highlights the need for stringent regulatory oversight in the cryptocurrency industry. The misuse of customer funds and lack of transparency in operations underscore the importance of robust governance and accountability mechanisms to protect investors and maintain market integrity.

As ASIC continues its investigation, the outcome of this legal action could set a precedent for future regulatory approaches to cryptocurrency exchanges and their directors' responsibilities.
